Does anyone know what I do now? They have my postdated check - I've been making payments because I don't have the full amount. Can they arbitrarily cash my check? Thank you.

Get the cash ASAP as they WILL cash your check. If there's another office in town, contact them immediately.... And don't use Payday loans ever again as the interest rates they charge are typically 180 to 300%.

These places MUST be registered with the Secretary of State to do business in your state. Callethem and give them all of the relevant details you have about the company. Also, if you do NOT get some GOOD answers in 1 week, put a stop payment on the check.



Your legal defense for this is that you have made SOME attempt to make the weekly paymyents but their %26quot;going out of Business%26quot; trick now puts your loan payments at risk. (They could unjustly enrich themselves by cashing your check and the excess ennumeration would not be worth your taking them to court for the difference)



Stop the check and make THEM come after you for the balance due AT THE TIME OF THEIR GOING OUT OF BUSINESS. No more interest should be paid by you on this loan until they make it clear as to WHERE you should make your payments and to whom.
