I work at a payday loan company in California and supposedly we can't hold a check over 31 days, my boss says its against
the law. This is usually a real problem when the first rolls around for the Social Secruity customers because they want to re-loan that day but most of the time they have to come back the next day or sometimes even a couple days later so we dont exeed holding the check 31 days. Now Ive searched for this so called law, but have found nothing. And every other place in town allows this holding over 31 days. Does anyone know if this is a real law or not?

Not sure about CA but in PA depending on the type of check, personal checks are 6 months. Usually that is the standard, UNLESS, written on the check it states %26quot;not valid after%26quot; or %26quot;cash within 1 month of date%26quot;.

from my understanding yes it is illegal to hold a company check more than 31 days. Unless the person it is issued to knows that it is available and why it is being delayed.

What you should do to be clear, is to call the State Banking Dept in your state and they can answer that question for you.
Also you are not supposed to force Social Security customers to come back the next day. Those are gov't checks and should be cashed immediately. You can get into big trouble by not cashing those checks when presented.
