I had to change bank account number to another because they were ACH W/D that did not come from me,so they took all my money. I got a new account and closed the other, that didn't solve my problem because I am broke and not money to pay my most important bills, like my electricy,water and other payments. If you do, they will send your account to a collection company, which will damage your credit. If the amount is large enough, they will sue you. I see this regularly on credit reports, of which I see a couple dozen a week.

Do yourself a favor: Live up to the agreement you made, and never use those companies again. Just having them on your credit reports harms your scores a bit.

In addition to the previous answers, most payday loan shops collect their own debts, therefore they are NOT limited to the FDCPA practices (fair debt collections). They can hound you at work, after hours, etc. Also, did you pay a fee in advance to borrow the money? If so, then the check was exchanged for cash and technically not a debt; therefore they can turn you over to the DA/County atty for prosecution of a hot check, depending upon the circumstances. As one person said above; pay them back and DON'T USE THEM AGAIN!

Frustrating isn't it. I have been in a similar spin and you just keep wasting money. It was suggested to me by a friend who worked in a bank to consider a debt consolidation loan. (that, I thought was the last thing I needed to do) but in the end that's what I did. It's important to stick with the reputable lenders though. I found one at a site called loans-only. I consolidated all my debts (I had 5) with a low interest rate and I was allowed to pay it off quickly without any penalties. Before that I was stressed out. I learned to borrow only when I have to from that pickle.

I find it hard to believe that you %26quot;forgot%26quot; that you owed this place money .. unless of course you owe so many people/places money that you've lost track of them all. Did you perhaps think by changing bank accounts, you could 'lose' this company that you owe money to, and they wouldn't be able to find you?

Passing bad checks is a FELONY in some states and yes you could be arrested and taken to jail.

I doubt very much that the processor filed any such charges. Probably what is filed is a summons to appear in Small Claims Court. You should contact the company to explain what happened, give them their payment(s) and the court thing will probably be dropped although you may be charged additional legal expenses.

collection agencies rarely say that unless they've been contacting you repetedly. furthermore, they often send that in writing, and don't call. they also don't offer such limited payment terms. i would first make sure this was a real agency by contacting them and requesting the info in writing. then if everything checks out i would try to work with them over a payment araingment. If it does go to trial, they will again offer you a payment araigment as the terms of settling. courts don't like to put people in jail, it's expensive. they'd rather mediate and plead out.

My suggestion is to negotiate the lowest possible payment necessary to close the account the agency is handling. You do have leverage to negotiating a settlement deal with them. Tell them you don't have the funds to pay the debt in full but will instead pay something like 60% of the balance owing. Threaten bankruptcy if you have to; they'll give if you're even half as persistent as those toads are. Also get everything in writing if they agree to deal with you.

And don't worry about jail; they can't throw you in the clink for one bad check (Just dont' make a habit of this or you *will* be put in jail.).
